Personal Information provided by you in relation to the use of the Website: In order for us to successfully service you,  we collect your Personal Information as may be required for the purposes connected thereto when you place a request on the Mobile App, Website or Telephone.

We may be required to disclose such Personal Information to the Third Parties solely in connection with service delivery of your request in accordance with the terms and conditions stipulated by such third Party. We may also be required to disclose such personal information if it is sought by any branch of the Govt., Judiciary or Law Enforcement Agencies.

We may use the details provided by you at the end of service to ensure that the service have been  successfully carried out on time, and to keep you informed on the status of your request if need be.

You can register to join us logging into online accounts you may have with Third Party service providers (“SNS”) (e.g. Facebook, Twitter etc.). As part of the functionality of the Website, you may link your account with Third Party Accounts, by either: (i) providing your Third Party Account login information to us through the Website; or (ii) allowing us to access your Third Party Account, as is permitted under the applicable terms and conditions that govern your use of each Third Party Account.   1. These terms of use (the “Terms of Use”) govern your use of our website (the “Website”) and our “Motormechs” application for mobile and handheld devices (the “App”). The Website and the App are jointly referred to as the “Services”. Please read these Terms of Use carefully before you download, install or use the Services. If you do not agree to these Terms of Use, you may not install, download or use the Services. By installing, downloading or using the Services, you signify your acceptance to the Terms of Use and Privacy Policy (being hereby incorporated by reference herein) which takes effect on the date on which you download, install or use the Services, and create a legally binding arrangement to abide by the same.
  2. The Services is operated and owned by MOTORMECHS TECHNOLOGIES PRIVATE LIMITED (hereinafter referred to as “Motormechs”, “we”, “us” or “our”).
  3. We reserve the right to change the Terms of Use and Privacy Policy at any time without notice, posting changes on the Website and you shall be liable to update yourself of such changes, if any, by accessing the changes on the Website. You shall, at all times, be responsible for regularly reviewing the Terms of Use and the Privacy Policy and note the changes made on the Website. Your continued usage of the Services after any change is posted constitutes your acceptance of the amended Terms of Use and Privacy Policy.
  4. How the Services and Service works
    • We are an Aggregator service provider providing you an online platform to (a) request service for your vehicle from the list of services available on the Services (“Vendors”); (b) pre-pay for your service request by banking channels made available to you on the Services or paying for the service by debit or credit card or cash after the service is performed.
    • We do not own, sell, resell, furnish, provide, manage and/or control the Vendors or the related services provided in connection thereof.
    • Our responsibilities are limited to: (i) facilitating the availability of the Services; and (ii) serving as the limited agent of each Vendor for the purpose of accepting payments from you for the services provided / delivered as per your request.
  5. Use of the Services
    • You represent that you are entitled to disclose your Third Party Account login information to us and/or grant us access to your Third Party Account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable Third Party Account and without obligating us to pay any fees or making us subject to any usage limitations imposed by such third party service providers.
    • We reserve the right to suspend or terminate your access to the Services if any information provided during the service process or thereafter proves to be inaccurate, not current or incomplete.

5.3 Service requests are intended for your personal vehicles and you represent that the same are not for onward service or you are not acting as an agent for other parties.

  1. Bookings and Financial Terms
    • The Services allows you to make request and we will, subject to the terms and conditions set out herein, co-ordinate with the specific service providers to provide the specified service at the designated location.
    • You understand that any request that you place shall be subject to the restrictions and limitations set out in this Terms of Use including, but not limited to, service availability and location.
    • As a general rule, all service request made are treated as confirmed.
    • However, upon your service request, we may call you on the mobile number provided to confirm the details of the request, the price to be paid and the estimated service time required. For this purpose, you will be required to share certain information with us, including but not limited to (i) the first and last name (ii) mobile number; and (iii) email address. It shall be your sole responsibility to bring any incorrect details to our attention.
    • In addition to the foregoing, we may also contact you by phone to inform and confirm any change in the service due to availability or unavailability of the request. At this time any change or confirmation of the request shall be treated as final. It is clarified that in the event you are unavailable on the phone at the time we are confirming the request, we will cancel your request and the provisions of the cancellation and refund policy below shall be applicable.
    • You can pay by credit card or debit card or net banking at the time of booking a request or you can pay by cash after the service is done.
    • You agree to pay us for the total amount for any service availed. We will collect the total amount in accordance with the terms and conditions of these Terms of Use and the pricing terms set forth in the applicable menu listing for the particular Vendor. Please note that we cannot control any amount that may be charged to you by your bank related to our collection of the total amount, and we disclaim all liability in this regard.
    • In connection with your request, you will be asked to provide customary billing information such as name, billing address and credit card information either to us or our third party payment processor. You agree to pay us for any confirmed service request in accordance with these Terms by one of the methods described on the Services e.g. by a credit card. You hereby authorize the collection of such amounts by charging the credit card provided as part of requesting the booking, either directly by us or indirectly, via a third party online payment processor or by one of the payment methods described on the Services. If you are directed to our third party payment processor, you may be subject to terms and conditions governing use of that third party’s service and that third party’s personal information collection practices.   2. Cancellations and Refunds
    • Cancellation
      • As a general rule you shall not be entitled to cancel your service request once accepted by you.
      • However, in the unlikely event of the service requested being unavailable, we will contact you on the phone and inform you of such unavailability. In such an event you will be entitled to cancel the service request and shall be entitled to a refund in accordance with our refund policy.
      • We reserve the sole right to cancel your service request in the following circumstance –
        • in the event of the designated address falling outside the service zone offered by us,
        • failure to contact you by phone to reconfirm your service request,
        • Non-availability of the service requested,
        • Failure due to reasons beyond our control or attributable to the service provider.
      • Refunds
        • You shall be entitled to a refund only if you pre-pay for your service request at the time of placing your request on the services and only in the event of any of the following circumstances:
          • your service request location is outside our designated service zones;
          • failure to contact you by phone,
          • You cancelling the request at the time of confirmation.
        • Our decision on refunds shall be at our sole discretion and shall be final and binding.
        • All refund amounts shall be credited to your account within 5 to 7 business days in accordance with the terms that may be stipulated by the bank which has issued the credit / debit card / net banking facility.
  1. Terms of service
    • You agree and acknowledge that we shall not be responsible for:
      • The services provided by the service provider including, but not limited, to spares and people delivering the same,
      • The service provider services or goods not being up to your expectations or leading to any loss, harm or damage to you,
      • The availability or non-availability of certain services or,
      • The service provider nor serving you to the satisfaction.
    • You may not be able to avail our Services if your delivery location is outside our current scope of Service. We will keep you informed of the same at the time of confirming your service request.
    • You understand that service time quoted to you at the time of confirming the request is an approximate estimate and may vary. We will not be responsible for any delay in the service of your request.
    • You shall undertake to provide adequate directions, information and authorizations to accept service. In the event of any failure to accept service, failure to service within the estimated time due to your failure to provide appropriate instructions, or authorizations, then such service shall be deemed to have been delivered to you and all risk and responsibility in relation to such service shall pass to you and you shall not be entitled to any refund for the same. Our decision in relation to this shall be final and binding.
    • You understand that our liability ends once your service request has been attended.
    • We constantly strive to provide you with accurate information on the Services. However, in the event of an error, we may, in our sole discretion, contact you with further instructions.
    • If you use the Services, you do the same at your own risk.
    • By using the Services, you agree that any legal remedy or liability that you seek to obtain for actions or omissions of service provider / third parties will be limited to a claim against the particular service provider or other third parties who caused you harm and you agree not to attempt to impose liability on, or seek any legal remedy from us with respect to such actions or omissions.
  2. General terms of use
    • Only individuals who are 18 years of age or older may use the Services. If you are under 18 years of age and you wish to download, install, access or use the Services, your parents or legal guardian must acknowledge and agree to the Terms of Use and Privacy Policy. Should your parents or legal guardian fail to agree or acknowledge the Terms of Use and Privacy Policy, you shall immediately discontinue its use.
    • If you choose to use the Services, it shall be your responsibility to treat your user identification code, password and any other piece of information that we may provide as part of our security procedures as confidential and not disclose the same to any person or entity other than us (“Third Party”). We shall at times and at our sole discretion reserve the right to disable any user identification code or password if you have failed to comply with any of the provisions of these Terms of Use.
    • As we are providing services in the city of Bangalore, we have complied with applicable laws of India in making the Services and its content available to you. In the event the Services is accessed from outside India or outside our delivery zones, it shall be entirely at your risk. We make no representation that the Services and its contents are available or otherwise suitable for use outside Bangalore. If you choose to access or use the Services from or in locations outside Bangalore, you do so on your own and shall be responsible for the consequences and ensuring compliance of applicable laws, regulations, byelaws, licenses, registrations, permits, authorisations, rules and guidelines.

    • In the event the Services is accessed on a mobile device, it is not associated, affiliated, sponsored, endorsed or in any way linked to any platform operator, including, without limitation, Apple, Google, Android or RIM Blackberry (each being an “Operator”).
    • Your download, installation, access to or use of the Services is also bound by the terms and conditions of the Operator.
    • You and we acknowledge that these Terms of Use are concluded between you and us only, and not with an Operator, and we, not those Operators, are solely responsible for the Services and the content thereof to the extent specified in these Terms of Use.
    • The license granted to you for the Services is limited to a non-transferable license to use the Services on a mobile device that you own or control and as permitted by these Terms of Use.
    • We are solely responsible for providing any maintenance and support services with respect to the Services as required under applicable law. You and we acknowledge that an Operator has no obligation whatsoever to furnish any maintenance and support services with respect to the Services.
    • You and we acknowledge that we, not the relevant Operator, are responsible for addressing any claims of you or any Third Party relating to the Services or your possession and/or use of the Services, including, but not limited to: (i) any claim that the Services fails to conform to any applicable legal or regulatory requirement; and (ii) claims arising under consumer protection or similar legislation.
    • You and we acknowledge that we, not the relevant Operator, are responsible for addressing any claims of you any Third Party relating to the Services or your possession and use of the Services infringes that Third Party’s intellectual property rights, we, not the relevant Operator, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim.
    • You must comply with any applicable Third Party terms of agreement when using the Services (e.g. you must ensure that your use of the Services is not in violation of your mobile device agreement or any wireless data service agreement).
    • You and we acknowledge and agree that the relevant Operator, and that Operator’s subsidiaries, are Third Party beneficiaries of these Terms of Use, and that, upon your acceptance of these Terms of Use, that Operator will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use against you as a Third Party beneficiary thereof.]

    • We cannot and will not assure that other users are or will be complying with the foregoing rules or any other provisions of this Terms of Use, and, as between you and us, you hereby assume all risk of harm or injury resulting from any such lack of compliance.
    • You acknowledge that when you access a link that leaves the Services, the site you will enter into is not controlled by us and different terms of use and privacy policy may apply. By assessing links to other sites, you acknowledge that we are not responsible for those sites. We reserve the right to disable links to and / or from third-party sites to the Services, although we are under no obligation to do so.
  7. Severability

If any of these terms should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction which that term is illegal, invalid or unenforceable, it shall be severed and deleted and the remaining Terms of Use shall survive, remain in full force and effect and continue to be binding and enforceable.

  1. Non-assignment

You shall not assign or transfer or purport to assign or transfer the contract between you and us to any other person.

  1. Governing law and dispute resolution

These Terms of Use are governed by the laws of India. Any action, suit, or other legal proceeding, which is commenced to resolve any matter arising under or relating to this website, shall be subject to the jurisdiction of the courts at Bangalore, India.

  • Motormechs shall provide service within the municipal limits of Bangalore city.
  • No of Services available / provided shall be as per the package/s selected and enrolled.
  • Membership shall be valid for the package enrolled from the date of activation, provided the membership is not cancelled/terminated before the date of expiry term.
  • If the Covered Vehicle has a punctured or burst tyre, Motormechs shall change it with the spare tyre carried in the Member’s vehicle. In case spare tyre is not in the vehicle, only tubeless tyres would be repaired on the spot at extra cost.
  • Services entitled to the customer can be refused or cancelled on account of abusive behaviour, fraudulent representation, malicious intent or refusal to pay for any charges related to services and spare parts, during service or on previous occasion by the customer.
  • Arrangement of fuel in emergency would be limited to FIVE litres chargeable at actual cost.
  • Our business/Support team shall be permitted to contact you for service feedback, renewals and sales during business hours on working days.
  • It is mandatory for the customer to produce either the helpline card/Sticker with membership number for availing the services.
  • If the vehicle is repairable on road, free towing will not be provided.
  • In case of major breakdown , our team shall help you in towing the vehicle to the nearest service station within the permissible limit as per the package and for the distance beyond the permissible limit, charges @ Rs.50/- per KM for front lift towing and Rs120/- per KM for Flat Bed towing shall be payable by the customer. For two wheeler towing Rs. 35/KM will be charged.
  • Towing is free only up-to the distance specified in the package enrolled.
  • Helpline services are only for the vehicle, not for people.
  • Vehicles less than 15 years and which are not used for commercial purpose shall only be entitled for the membership. Commercial vehicles not less than 15 years can avail commercial membership only.
  • Motormechs will try and ensure to provide service within the stipulated time of 30 minutes but it can’t be held responsible for delay arising due to conditions not within its control, such as – traffic jams, riots, road block, route diversions, rain etc.
  • Services are provided / available for only when the vehicle develops fault while on the road.
  • Reach time for service provided at home will be 90 – 120 minutes, since preference is given to on road breakdown vehicles.
  • For similar mechanical fault, service will not be provided more than two consecutive time, but could be attended at a cost as applicable.
  • Claims/Refunds if any will not exceed the residual value (prorate basis of membership Validity Period) of the membership fees paid by the member as on the date of the claim.
  • Towing service shall not be provided during restriction hours if any imposed by the traffic police.
  • No services will be provided on Ayudha Puja Day and Vijayadashami Day
  • The customer or its representative will have no claim against the company or its representative either civil or criminal nature or pursuant to membership in respect of death or injury of the customer or any other person or loss or damage to any other property caused by or due to equipment failure, breakdown or accident or fire on utilization of service during the validity of the membership.
  • Membership is valid for one year from date of subscription/renewal.
  • Cost of spares (if any) will be on chargeable basis to be paid by the customer on the spot.
  • In case of an accident, towing will be provided by crane at actual cost.
  • Membership renewal shall be sole right of the Company.
  • Company reserves the Right to terminate the Membership by refunding the membership fee not exceeding the residual value.
  • It will be considered that all the terms & conditions are accepted by the member once the payment is made towards the package selected.
  • All disputes are subject to jurisdiction of Bangalore courts only.
  • In case of trial offer, 45-60 Mins TAT would be applicable.
  • Membership once sold will not be taken back.
  • In event of any damage during towing, the maximum liability of Motormechs is of Rs 2500/- only.
  • Motormechs on its sole discretion can change any or all the terms and conditions without any prior intimation.
  • Events which do not render the vehicle immobilised are not covered under the program. Some example of such events are given below:
  1. Boot cannot be opened
  2. Non-functional horn.
  3. Faulty fuel gauge
  4. Faulty Speedometer.
  5. Air-conditioning fault.
  6. Faulty demisters.
  7. Headlights not functional
  8. Non-functional Seat adjustor but the vehicle can be driven safely.
  9. Illumination warning lamp of ABS, airbag warning or traction control or any such non-safety related lights/service warnings lights which do not render the vehicle immobilized.
  10. In the event of passenger doors not opening or seatbelts not functioning
  11. Damaged door glasses or non-functional windows
  12. Broken rear-view mirrors.
  13. Damaged or faulty fuel cap but vehicle has sufficient fuel to reach the nearest authorized dealer.
  14. Faulty Windscreen wipers
  • Motormechs on its sole discretion can change any or all the terms and conditions without any prior intimation.
Special Exclusions
  • Vehicle goes through conditions of motor racing, motor rallies, over speeding or duration tests, practice runs or operating outside official/main roads.
  • Unavoidable causalities/act of god.
  • Immobilization results from destruction caused by intercession of police or other authorities.
  • Non-Active/Registered Membership.
  • Roads mentioned hereinafter means main roads of city selected by the member and shall not include interior roads, side lanes, and service lanes of any colony under any circumstance. Therefore the member shall not be entitled to get the services as per the stipulated time of 60 minutes in the by lanes. .
  • Engine transmission, transaxles drive axle/differential assembly. Auto body, paint molding repair, any repairs involving replacement or removal of internally lubricated parts, clutch replacement, other major repairs.
  • Vehicle which has not been maintained regularly as per the guidelines of respective car manufacturer and thus is not in roadworthy condition.
  • Breakdown is caused by deliberately inflicted damage, vandalism or participation in a criminal act or offence.
  • Customer history – where customer has twice on prior occasions misused or abused the services.
  • Driver of the vehicle is found to be in any of the situations that are indicated below:
  1. Intoxication or under the influence of drugs, toxins or narcotics not medically prescribed. When under the effect of alcohol here the degree of alcohol in the blood is greater than that authorized by the legislation on traffic, motor vehicle circulation, road safety, or similar ones in the country where the incident occurs.
  2. Lack of permission or corresponding license for the category of the Covered Vehicle or violation of the sanction of cancellation or withdrawal of them. e) Those accidents resulting from the illegitimate removal of the Covered Vehicle.
  • Accidents or breakdowns that are produced when the Client or the authorized driver have infringed upon the regulatory ordinances as far as the requisites and number of persons transported, weight and means of things and animals that can be transported or the form of handling.
  • Vehicle without proper documentation or requisites (including the Technical Inspection of the Vehicles and Obligatory Insurance) legally necessary to drive on public roads in the country where the Covered Vehicle is found.
  • Vehicle involved in or liable to be involved in legal case prior to or post immobilization.
  • Damage caused by fuels, mineral essences, and other inflammable, explosive or toxic materials transported in the member Vehicle.
  • Public vehicle like ambulances, taxis, police vehicles and/or fire brigade vehicles and any other vehicle not used for private use are excluded of all the service coverage under these general conditions.
  • Accident or breakdown caused due to usage of the vehicle for racing, rally and criminal activity purposes.
  • Luggage that is not sufficiently wrapped or identified, fragile luggage or perishable products, and any commercial goods carried in the member Vehicle
